The Marker in the Back

Sure Enough, There is a Marker!

My former neighbors in that house were Originals. In 1953, many families settled in our town when they found work with US Steel. We’ve been living here for 35 years, but our former neighbors moved here in 1953. None of us had fences and the backyards were all open until 20 years ago, when we put in a pet fence that was inside our property boundaries to save on cost. Their daughter told me she remembered a marker at the back corner, but she was never able to find it. Truth be told, it is even farther over than we knew. The marker is an iron pipe that could have been a corner pole for a fence. Here it is, below:

I put a piece of blue material i found nearby next to the pole base to make it easier to find. Note how it is very close to the survey point and new iron marker, at the back corner. December update: in clearing out the area around the reclaimed area, I found a concrete setting for the next fence post in line with the one above. I put a temporary fence up there recently.

Look how far their fence encroaches onto our property! From this marker, the fence is 20 feet to the corner, at an angle. Straight across, their fence is about 17 feet onto our property. In legal parlance, this is adverse possession.

I look forward to getting my property back! Code Enforcement told them 2 years ago that their fence encroaches on our property. So far, they have made no effort to move it. Note their generator, on the right, that is on our property.
